1. APPLICATION OF TERMS
Our acceptance of your order for our products is limited and conditional upon your own acceptance of these terms. All prices provided are subject to change. These changes are determined by Anova Cabinet and Stone. Terms may not be waived, changed or modified except by an agreement in writing that has been signed and acknowledged by an Anova Cabinet and Stone representative. 2. SHADE VARIATIONS
Anova Cabinet and Stone will strive to provide our customers with accurate samples of products that have been selected by said customer. Please note that shade variation in both manufactured stone and raw slabs is to be expected. Changes cannot be made to these grain and color variations, and customers must inspect their purchase at pick-up for verification. Customer may choose from a different, existing slab for better accuracy upon request. Anova Cabinet and Stone offer no guarantees of variations in color for raw or manufactured slabs.
3. CANCELLATIONS AND/OR RETURNED GOODS
Anova Cabinet and Stone does not allow returns for countertops, backsplash, assembled cabinets, sale items, closed out items, OR special orders. All other approved returns are subject to a 25% restocking fee and must be in original and resalable conditions within 30 days from purchase date. No adjustments will be made after product has been installed. All purchases not picked up within 7 days will be subject to a storage fee of $25/day. For safety reasons, customer pick-ups that involve material like countertops WILL NOT be allowed to leave the premises without proper securing of the product with an A-Frame. An A-Frame may be rented for a fee of $1,000.00. The fee will be reimbursed to the client upon return of the A-Frame, in the same condition that it was rented in. Anova Cabinet and Stone is not responsible for damages after leaving our premises.
4. TERMINATION OF CONTRACT AND SERVICES
Customer may cancel this contract without any obligation penalties according to terms and condition of contract within 3 business days after being signed. 10% of the contract price will be charged for cancellation thereafter. In regards to installation, any changes to schedule must be made aware of to Anova Cabinet and Stone through email at info@anovacabinetstone.com at least 2 business days prior to avoid charges, otherwise a fee of $250.00 will be charged. If customer fails to cancel installation schedule and our installer has already arrived at the premises, a fee of $500.00 will be charged. Future installation schedule will be based on the soonest possible availability.
5. MEASUREMENTS AND DAMAGES
If measurements are obtained by the client, Anova Cabinet and Stone will not be responsible for any parts or materials that may not conform to specifications that may have been damaged or are unfit for further installation. Storage of such parts or materials may be stored in our warehouse for UP TO ONE WEEK. If you have not had these materials within the ONE WEEK timeframe, you may be subject to pay for these materials. Measurements can be done by our Anova Cabinet and Stone team with a fee of $150, that will then be counted towards final fee of purchase. $150 payment will not be refunded if purchase is not completed. Anova Cabinet and Stone is not responsible for damages after leaving our premises.
6. INDEPENDENT CONTRACTOR
For independent contractors, you acknowledge these terms and conditions do not hold you liable for payment as an individual and are not obliged to pay Anova Cabinet and Stone for any products, material or services the client purchased if client has cancelled or failed to complete payment.
7. WARRANTIES AND AUTHORITY TO BIND
Warranties
will only be included for purchases including installation as a 1-year,
non-transferable workmanship warranty from the installation date. Workmanship
warranty does not cover anything caused by misuse, acts of God, foundation
problems, settlements, lack of maintenance, and water or ultraviolet light
damages. If buying material or product without installation services, no
warranty is guaranteed. Warranties are not included for outdoor installations
due to unforeseeable and uncontrollable environmental factors. Warranties also
do not include coverage for heat damage of any kind. Any warranty is not under
authorization to bind. You shall be solely responsible for the performance of
the product or materials after the warranty has ended and will not hold Anova
Cabinet and Stone accountable for any damage or issues with product after the
warranty has ended.

Disclaimers
While many of our countertops at
Anova Cabinet and Stone are cut from real, natural stone, we use high definition,
3-D technology for designs on all of our countertops reveal the outward look
for the natural stone underneath. With this technology, we are able to
seamlessly showcase the package deal of real stone and natural patterns to each
of our countertop products. These eye-catching surface designs are carefully
manufactured by our partners in order to best capture
this natural look.
Warnings
Some products can expose you to chemicals including crystalline silica, which is known to the State of California to cause cancer. SILICA DUST HARMFUL IF INHALED. Repeated inhalation of respirable crystalline silica dust from cutting, grinding, polishing, intentional breaking, machining, sweeping, or other clean-up tasks during fabrication can cause acute lung injury, silicosis, or cancer. Wear a respirator when cutting, grinding, polishing, intentionally breaking, machining, sweeping, or cleaning up during fabrication as required by the Cal/OSHA standard. DO NOT DRY CUT. Segregate work involves repeated cutting, grinding, polishing, intentional breaking, or machining. Wash contaminated clothing before reusing. KEEP OUT OF REACH OF CHILDREN.
Usage & Care
Cleaning
DO
NOT allow your countertop to come into contact with materials such as drain cleaners,
paint strippers, acetone, or any product containing Ammonia, high PH, or low PH.
Results will cause Anova countertops to become discolored or damaged. Regular cleaning
may include a soft material with warm water. Stubborn stains may be neutralized
with usage of a neutral PH liquid cleaner or a dish washing detergent with a
soft material and warm water. If stains persist, DO NOT use bleach. DO NOT use
aggressive force, abrasive non-chemical cleaners, bleach, or sponges with
aluminum oxide to avoid dulling or damaging Anova Cabinet and Stone
countertops. Some products may be porous
and require sealing.
How to Avoid Damage and Marking
To avoid
heat damage, use a trivet, hot pad, or oven mitt between countertop and any
heated device including but not limited to hot pans or pots. Thermal expansion
may occur if temperature rapidly changes by increasing or decreasing too
quickly. Marking caused by regular,
everyday use of the countertop will be surface-level only, and can be remedied by
taking cleaning actions listed above. Constant daily use may result in different
levels of oxidation and discoloration that will be unique to each installation.
Please advise this is a normal and natural occurrence. Some products should not
be used outdoors and would be best suited for indoor use to avoid damages from
weathering and environmental causes.
